The managing partner is, essentailly, the CEO of a mulit-million dollar enterprise. As such, the CEO should focus attention on setting the strategic direction of the organization, building consensus among its owners, and initiating changes necessary to insure the long-term success and prosperity of the law firm.

Why AI Success Depends on Leadership, Not Software

This provocative four-page article raises real leadership concerns, and the opening paragraph captures its central argument:

“95% of legal professionals believe generative AI will be central to their organization’s workflow within five years. Yet, according to the same Thomson Reuters report, more than half of firms have no AI policy, nearly two-thirds have had no training, and few firms have articulated a coherent leadership stance. This is not a technology gap. It is a leadership gap – and it is already undermining client trust, talent retention, and competitive positioning. The firms that lead the next decade will not be those with the most advanced software, but those with the most effective leadership response.”

We are seeing the same data points and thought patterns in MPF Surveys and Zoom discussions among law firm leaders. Definitely worth a read – and yet another critical responsibility being added to your already full leadership plate!

2023 State of the Corporate Law Department

This report is based on interviews with more than 1,500 in-house lawyers and professionals through 2022, and here are a few note-worthy highlights:

  • Sixty-five percent (65%) of corporate legal departments report more matter volume, while fifty-nine percent (59%) say they are working with flat or declining budgets.
  • Regulatory compliance has emerged as the top concern for corporate legal departments.
  • In search of better value and service, work is being shifted among outside firms. We believe that this presents a big opportunity for smaller and midsize firms, which typically offer a much better value proposition than BigLaw.

This a good report to digest if your firm works (or strives to work) with larger corporations and in-house legal departments.

Mitigating the Psychological Impacts of COVID at Your Law Firm

Larry is a long-time member of the MPF Faculty and expert on the lawyer personality. As always, we collect and share current data through survey questions and audience polling. Here is some of what we learned:

  • Eighty percent (80%) of firm leaders think some of their firms’ lawyers are struggling with impacts of COVID. Ninety-two percent (92%) say they have support staff who are struggling.
  • Ninety-three percent (93%) report increased “distractibility” or “anxiety” among their people. 
  • Seventy-five percent (75%) of firm leaders say they are proactively reaching out to their people to make sure they are doing OK. People living alone and those with young kids are especially vulnerable.
  • Providing “social support” is the most beneficial thing law firm leaders can do to mitigate the impacts.

Which KPIs Are Best for Your Law Firm?

On the latest installment of The MPF Webinar Series we call “The Law Firm of the Future.” we discussed the importance of measuring both financial and firm-building contributions. In addition to plenty of timely benchmarking data on the topic, the handouts include biographical profiles, PowerPoint deck, and the raw data from The MPF 2019 Law Firm Leadership survey

Here are a few highlights:

  • Eighty-five percent (85%) of firm leaders say they use KPIs to monitor firm and individual performance. “Productivity” was by far the #1 metric they monitor. 
  • Twenty-six percent (26%) of firms have modified their KPIs since the COVID outbreak. Another twenty-four percent (24%) are considering it.
  • Looking beyond financial KPIs, just twenty-four percent (24%) of firms measure client satisfaction and thirty-five percent (35%) measure employee satisfaction.

Update on PPP Loan Forgiveness

We thank Scott Burke, Managing Partner of Morrison Mahoney LLP; Dan Mayo, National Lead-Federal Tax Policy of Withum; and Lisa Murray, Head of Professionals Banking of Citizens Bank, for their insights and perspectives on this timely and important year-end topic for many, many law firms. 

As always, we collect and present survey data on our topic (183 law firm leaders participating) and learned the following:

  • Ten percent (10%) of firm leaders report that their law firms have applied for PPP Loan Forgiveness, and have been approved by both their bank and the SBA
  • On the other hand, fifty-one percent (51%) had not yet applied for Loan Forgiveness
  • Eighty-three percent (83%) expect to receive 100% forgiveness

As to the long-term impact of COVID-19 on the legal industry, thirty-three percent (33%) of firm leaders say it will “fundamentally change the practice of law as we know it,” a whopping, five-fold increase from when we asked the same question in May.

Budgeting Considerations for 2021

Our MPF Webinar entitled “Budgeting Considerations for 2021” with Frederick J. Esposito, Jr., Chief Operating Officer of Rivkin Radler, LLP and Tom Obermaier, Chief Executive Officer of SurePoint Technologies.119 firm leaders participated during the live session, and here are a few of the things we learned:

  • Twenty-six percent (26%) of firm leaders project in an increase in Revenue per Lawyer (RPL) for their firms in 2021 compared to 2020.
  • Sixty percent (60%) of firm leaders report a substantial increase (10% or more) in their firms’ investments in technology in 2021.
  • Thirty-seven percent (37%) report an increase in their firms’ marketing and business development budgets in 2021.
  • Seventy-four percent (74%) are planning associate raises in 2021, with forty-three percent (43%) looking at increases of five percent or more. Raises are not as generous for non-lawyer support staff.

We had a very interesting and thought-provoking conversation about the growing trend for law firms to move toward virtual business models as we work through the immediacy of the pandemic and look toward a post-COVID environment. Here are a few program highlights:

  • In the remote working environment, partner productivity has slightly increased, while associate and staff productivity have significantly decreased.
  • Twenty-eight percent (28%) of smaller and midsize law firms have decided to move to a more virtual business model. Fifty-one percent (51%) are considering it. 
  • The biggest concerns are the impacts on associate development and training, and maintaining a collaborative firm culture.

  • 57% of law firms project total firm revenue in 2020 to decline between 11-25% due to the coronaviris outbreak. 11% anticipate a hit of more than 25%.
  • Postponing major investments, eliminating discretionary spending (mostly travel, client events and the like),and reducing partner draws are the top three ways firms are reducing short-term expenses.
  • As of Wednesday, 99% of firms reported that they had applied for a PPP loan. Nearly half said they had been approved, and 12% reported that they had already received the funds.

Since mid-March, we have been presenting an MPF Webinar series called “Responding to the Coronavirus Pandemic.” This session we called “Marketing Your Law Firm During a Pandemic” with Guy Alvarez, Founder of Good2BSocial, and Lynn Tellefsen, Chief Marketing and Business Development Director of Wilentz. Here are some of the highlights of what we learned:

  • 82% of participating law firm leaders believe that it is “very important” to build and maintain their firm’s marketing efforts during the pandemic. Another 15% say it is “somewhat important.”
  • 46% of firm leaders report that their firms provide business development training for all lawyers who want it.
  • Among digital marketing tactics, 78% report that their firms distribute e-newsletter/alerts, and 61% say they are presenting webinars.

We had a terrific session and, as always, presented plenty of timely bench-marking data.

  • 53% of firm leaders believe that “productivity” declines of 10% or more when people work from home. 11% see declines of more than 25%.
  • Too many distractions, lack of structure and little accountability are the primary reasons.
  • 73% think the pandemic has accelerated long term trends in the profession in areas like flex-time, work-at-home and the use of technology.

Although geared primarily toward “BigLaw,” its content is also timely and relevant for smaller and mid-size law firms. In this edition, the most important article for you to read is “Law Firm Strategic Planning: A Report on the State of the Art. Even though 97% of AmLaw 200 firms have strategic plans, Patrick observes that far too many of them suffer from a self-inflicted phenomenon call “SPOTS”…an acronym for “Strategic Planning on the Shelf.” To avoid that situation at your firm, keep your plan simple, realistic and achievable. Importantly, the plan must also involve partner accountability. 

Here are his four main points for successful strategic planning:

  • Too many firms are focusing attention on internal (not external) issues.
  • More firms need to involve clients in their strategic planning process.
  • Implementation improves when more partners are involved in the process.
  • More rigorous management attention and individual accountability will improve implementation.

AUDIENCE POLLING RESULTSThe MPF 2014 Leadership Conference 

We’re pleased to share the audience polling results from The MPF 2014 Leadership Conference held on May 8, 2014 in Atlanta. More than 100 managing partners and firm leaders participated. The bench-marking data in this slide deck is especially relevant to smaller and mid-size firms.

Among the highlights:

  • Sixty-eight percent (68%) of managing partners believe that the legal profession has experienced profound and permanent change over the past ten years.
  • Thirty-two percent (32%) of firm leaders are “very concerned” about their firm’s long-term viability.
  • Sixty-five percent (65%) don’t think their younger lawyers are up to the task of inheriting the firm.
  • Seventy percent (70%) believe that a firm-wide strategic plan is “absolutely essential” to lead a successful firm.
  • The top three initiatives firms have implemented in response to the changing market are: 1) Ramp up marketing and business development. 2) Improve internal processes and procedures. 3) Pursue lateral hires with books of business.
  • Eighty-eight percent (88%) of managing partners say they enjoy the leadership role.

More than ever, strong and effective leadership is necessary in today’s highly competitive and rapidly changing market.

How to Build Trust

This seven-and-a-half (7-1/2) minute video about building trust and leading change is well worth the time. In it, Spence talks about how effective change leaders can build trust among those they lead. He discusses the “Four C's of Trust:” Consistently Communicating that You Are Competent and that You Care.

He talks further about “high source credibility” that you, as a leader, earn over time as you competently and reliably handle situations and relationships with those around you. Importantly, trust can take weeks, months, even years to build, but it can be lost in an instant. Building trust among partners is especially important for law firm leaders who are charged to lead an especially tough group – lawyers who are high on skepticism, hate change and love autonomy. AUDIENCE POLLING RESULTS The MPF 2015 Leadership Conference

On May 7th, more than 100 managing partners and law firm leaders gathered in Atlanta to learn with and from peers at our 24th law firm leadership conference. During the Opening Session, we featured audience polling technology to collect input on a variety of issues ranging from strategic planning to the authority they have as managing partners. The results were instant and anonymous. Here are some of the more interesting findings:

  • Thirty-five percent (35%) of firm leaders report that their firms have a written strategic plan. Twenty-three percent (23%) say they’re working on one.
  • Of firms with a plan, sixty-seven percent (67%) attribute improved sharing and teamwork to the plan. Fifty-two percent (52%) attribute improved profitability to the plan.
  • Of firms without a plan, lack of time is the number one reason why.
  • Eighty-nine percent (89%) of managing partners say they enjoy the leadership role.
  • Seventy percent (70%) say they have no formal job description, and half don’t want one! They like the flexibility.
  • Leading change, implementing long-term strategic goals and building consensus among partners are the three most important contributions leaders believe they provide their firms.

Altogether, we presented twenty-seven (27) questions, and the results provide terrific bench-marking data for you and your firm.

Last week, we spoke at the 20th Annual Meeting of LEGUS, an international network of law firms, in New Orleans. We were asked to discuss the importance of investing in young lawyers and grooming them for a successful future. Generally, law schools aren’t doing a very good job training and developing “practice-ready” lawyers. And most law firms aren’t doing a stand-out job either when it comes to training them in areas such as time management, billing practices, marketing and business development. Building for the Future Audience Polling Results from The MPF 2016 Leadership Conference

On May 5, 2016, more than 100 managing partners and law firm leaders gathered in Atlanta for The MPF 2016 Leadership Conference. During the opening session, we distribute audience polling devices and asked participants to weigh in on a variety of issues important to leading a successful mid-size law firm. The polling technology is fun, and the results are anonymous and instantaneous. Looking at the data, here are a few highlights from this year’s Conference:

  • Ten percent (10%) of firm leaders report that their firms use psychological assessment tools as part of their hiring and recruiting process. With few exceptions, Fortune 1000 companies use these instruments routinely as they onboard and assess talent. Given the importance of recruiting and retaining top legal talent, shouldn’t your law firm be using them as well?
  • Thirty-eight percent (38%) of firm leaders say their law firms provide leadership training to junior partners and associates. Sixty percent (60%) say their firms provide training in marketing and business development. To be competitive in the long run, law firms must invest in the “soft skills” of their young lawyers.
  • Seventy-three percent (73%) of firm leaders report that that their firms are doing a “fair” or “poor” job when it comes to grooming future leaders. Just two percent (2%) say “excellent.” If your firm’s owners care about succession, here’s an area where most firms can improve.
  • Forty percent (40%) of firm leaders say their law firms are proactively dealing with underperforming equity partners. Fifty-nine percent (59%) report that they want to act, but have yet to do anything about the situation. Healthy and successful law firms recognize the importance dealing with partners who aren’t pulling their weight.

Current Issues, Trends and the Challenges Facing Today’s Law Firms…And What They’re Doing About It!

Too many lawyers. More demanding clients. Increasing competition. Industry consolidation. Globalizing economy. Advances in technology. Proliferation of disruptors. Yikes! What’s a law firm to do? As we know, change surrounds the legal industry, yet smaller and mid-size firms have been slow to adapt and evolve.

On July 19th, we presented a hard-hitting program for 70 managing partners and firm administrators in Chicago. To prepare, we drew upon bench-marking data we collected for The MPF Leadership and Governance Survey (147 firms, April 2016) and the Audience Polling Results we collected at The MPF 2016 Leadership Conference (87 firm leaders, May 2016). We also provided some strong advice to leaders of mid-size firms. Here are a few highlights:

  • Mid-size law firms are slowly moving toward more formal, structured governance models.
  • Firms with strategic plans report positive results, yet more than half of mid-size firms don’t have one.
  • Marketing, succession planning and growth top the list of strategies priorities for mid-size firms.
  • Despite what we read and many have predicted, alternative fee arrangements are not taking off.
  • 60% of managing partners confess that they are not dealing with problematic partners as they know they should.

Investing in Law Firm Leadership

More than ever, running a successful law firm in today’s evolving and cut-throat marketplace for legal services requires a commitment to planning and leadership. Yet, when it comes to leadership training, recent MPF surveys suggest that smaller and mid-size law firms are doing an abysmal job in this important area. For example, 75% of managing partners report that their firms are doing a “fair” or “poor” job grooming future firm leaders, and only 32% of managing partners indicate that their firms provide any kind of leadership training for its young lawyers.

Leadership Insights in the Age of Millennial Lawyers

Do You Know What It Takes To Be An Effective Firm Leader?

Each year, he also presents a one-day Workshop called “The First 100 Days” for leaders of large law firms. In this article, he provides 29 tips to be more effective in the challenging, often ill-defined, role of law firm leaders. Among his suggestions:

  • Attend to the needs of your family, as your change in responsibilities will affect them whether you acknowledge it or not.
  • Be ready to deal with the sudden isolation associated with the leadership role. As they say, it can be lonely at the top.
  • Set your own path, and avoid undue bias from your predecessor’s priorities, influence and style.
  • Carefully manage your daily agenda, including ample “walking around time” to interact regularly with your colleagues.
  • Pick your battles carefully, as moving too quickly can cause as many problems as moving too slowly.
  • Achieve some quick, small, visible successes early on to inspire initial confidence in your leadership skills.

Report of the 2018 NAWL Survey on Retention and Promotion of Women in Law Firms

In our work with smaller and mid-size firms, we find that most have challenges achieving diversity and inclusion. And they are not alone as even the largest US law firms face similar challenges.
 
Since the mid-1980s, the majority of law school graduates have been women, yet only 20% of equity partners at AmLaw 200 are women. As they move up the ranks, many opt to take the non-equity partner track, others move to in-house positions and others choose to start families and leave the profession altogether. This report looks at the career paths of women attorneys in the largest US law firms.

On the bright side, the report finds that women occupy a higher percentage of leadership roles within their firms. Here are few findings:

  • Twenty percent (20%) of women in AmLaw 200 firms will become equity partners in the course of their legal careers.
  • People of color comprise eight percent (8%) of equity partners, LGBTQ persons stand at two percent (2%) and persons with disabilities comprise just one percent (1%) of law firm owners.
  • Women make up twenty-five percent (25%) of leadership roles in their firms, including twenty-two percent (22%) of firm-wide managing partners, twenty percent (20%) of office managing partners, and twenty-two percent (22%) of practice group leaders.

The White Paper also reveals strategies and tactics that firms are using to address the issue.

Five Tips for Facing Non-Performing Partners Head-On

According to Altman Weil’s 2018 Law Firms in Transition report, eighty-three percent (83%) of law firms admit to having chronically under-performing equity partners within their ranks. Instead of avoiding the issue (as many firms do), Tea recommends that law firm leaders address non-performance early on and at the first sign of a problem. She offers these five tips:

  • Begin with the End in Mind
    Hire the right people in the first place. Use psychological assessment tools as part of your hiring process.
  • Begin Biz Dev Early – But Don’t Necessarily Write-off the Late Bloomers
    Start training your associates early. Don’t wait until year six or seven to invest in their rainmaking skills.
  • Track, Praise and Reward Success
    What gets measured gets done, and positive reinforcement is a huge motivator.
  • Realize that Being Kind May Be Cruel
    Sweeping the issue under the rug is not healthy for the firm or the non-performer.
  • Avoid a Failure of Leadership
    Set goals, maintain standards and hold people accountable.

We agree completely with the point Tea makes in her article. Leading a law firm is not an easy job. Leading a law firm requires courage. With rare exceptions, chronic under-performance must not be tolerated.

Seven Ways Managers Motivate and Demotivate Employees

Dr. Travis Bradberry

According to Gallup, 70% of employees are disengaged at work. Furthermore, 70% of an employee’s motivation is directly influenced by his/her manager or supervisor. Motivated employees are 37% more productive, and they’re 87% less likely to quit. When it comes to your law firm, substitute the term “Equity Partner” for “Manager/Supervisor” and the words “Associates/Support Staff” for “Employees.”

For starters, Travis says you need to stop making things worse by eradicating seven negative behaviors. Here are three of them:

  • Letting Accomplishments go Unrecognized,
  • Tolerating Bad Performance, and
  • Going Back on Commitments.

After that, you should go to work on making things better. He sets forth seven things you can do to make people love their jobs. Here are three of them:

  • Be Strong, Not Harsh,
  • Be a Role Model, and
  • Be Humble.

We’ve observed that many Equity Partners receive little or no training on how to be a good boss. This is a nice article to circulate and discuss at an upcoming partnership meeting.

The State of Law Firm Leadership

The role of law firm maning partner is like no other and they teach you little about how to lead lawyers in law school. This report summarizes the results of a 30-question survey in which 86 firm leaders from BigLaw participated. It asks about priorities, job descriptions and time spent in the leadership roles. Its findings are relevant for leaders of smaller and mid-size firms, as well. Here are a few highlights:

  • Fifty-six percent (56%) reported that the leadership role was a full-time job.
  • Sixty-seven percent (67%) said they have no formal job description.
  • Thirty-seven percent (37%) said they were the only candidate for the position.
  • Strategic planning, initiating change, and responsibility for firm performance are what firm leaders enjoy most about the leadership role.
  • Day-to-day administration, thorny people issues, and inter-office travel is where they spend most of their time.
